These Terms & Conditions (“Agreement”) apply to all purchases from APAX CORALS (“we,” “our,” “us”) and constitute a binding contract between the customer (“you,” “your”) and us. By purchasing livestock, products, or services from us, you agree to these Terms in full.

1.1 We specialise in aquaculture and the sale of coral and related livestock.
1.2 All corals are grown, cared for, and shipped by us with the highest standards.
1.3 We reserve the right to refuse service, cancel orders, or withdraw products at our sole discretion.

2.1 We guarantee that all corals and livestock leave our facility healthy.
2.2 We offer a Live Arrival Guarantee (LAG) strictly under the Dead on Arrival (DOA) Reporting Procedure (Section 3).
2.3 If a DOA claim is approved, compensation will be made in the form of a credit note only (no cash refunds). Shipping costs are non-refundable.
2.4 If you are unavailable to receive the package on the first delivery attempt, or the courier experiences delays outside of our control (e.g., weather, strikes, misrouting, customs checks), the LAG will be void.

3.1 In the unlikely event that your order arrives DOA, you must adhere to the following procedure. Failure to do so will void your claim:

• Notification: Email us at accounts@apaxcorals.co.uk within 1 hour of delivery confirmation. The email must include your order number and the subject line: “DOA Claim – Order #[your order number]”.
   
• Photographic Evidence: Provide clear, unedited photographs of the marine life in its original, unopened container/bag with the seal intact. The photographs must clearly show the specimen. Blurred, distorted, or unclear photos will not be accepted.
   
• Additional Photos: You may be asked to provide further images if initial photographs are not clear enough to assess the claim.
   
• Delivery Requirement: Someone must be present to sign for the parcel on the first delivery attempt. Missed deliveries or unattended parcels void all claims.
   

3.2 Claims without satisfactory evidence will not be processed.
3.3 On acceptance of a valid DOA claim, a credit note will be issued to your account for the value of the deceased livestock.

4.1 Livestock is shipped via 24-hour delivery to minimise stress.
4.2 Delivery will be made to the address provided at checkout, and you are responsible for ensuring someone is available to receive and sign for the parcel.
4.3 We take all reasonable steps to ensure safe and timely delivery. However, once the shipment leaves our facility, factors such as courier delays, handling, or weather conditions are outside of our control.
4.4 Please be aware that responsibility for the shipment passes to you once the courier accepts the package.

5.1 Proper acclimation is critical. We provide recommended acclimation guidelines, which must be followed to reduce stress.
5.2 Our guarantee does not extend to losses caused by:

• Failure to acclimate livestock correctly.
   
• Incompatible tankmates, water chemistry issues, or inadequate systems.
   
• Improper lighting, flow, or placement.
   

6.1 By purchasing livestock, you confirm that:

• You have a suitable, cycled aquarium capable of sustaining the species purchased.
   
• You understand the care requirements of the livestock.
   
• You are at least 18 years old and legally able to enter into this agreement.
   

6.2 You agree not to misuse our products or services, including reselling without consent.

7.1 Due to the perishable nature of livestock, returns are not accepted.
7.2 Non-livestock items may be returned only in accordance with UK consumer law, provided they are unused and in original packaging.

8.1 To the fullest extent permitted by law, we disclaim liability for:

• Any indirect, incidental, or consequential damages.
   
• Losses due to customer negligence, improper acclimation, or poor tank conditions.
   
• Website errors, downtime, or inaccuracies.
   

8.2 Our total liability under any claim will never exceed the value of the product purchased.

9.1 All website content, images, text, and media are protected under copyright law.
9.2 Customers may not reproduce, distribute, or use our content for commercial purposes without written consent.

10.1 You agree not to use our site or services for unlawful purposes, harassment, spam, or harmful activities.
10.2 We reserve the right to suspend or terminate accounts that violate these terms.

11.1 These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.
11.2 Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12.1 We reserve the right to update or amend these Terms & Conditions at any time without prior notice.
12.2 Continued use of our services constitutes acceptance of the updated Terms.

By placing an order, you confirm that you have read, understood, and agreed to these Terms & Conditions in full.

• While we take care to provide accurate descriptions, photographs, and advice, coral appearance may vary due to lighting, water conditions, and individual differences. Colours may appear differently under various aquarium lighting setups.
   
• Any care, acclimation, or husbandry advice provided on our site or by our team is based on experience and general best practice, but we cannot guarantee outcomes in individual tanks. Success depends on your system setup, maintenance, and compatibility with existing livestock.

• Customers are solely responsible for ensuring they have the knowledge, equipment, and conditions required to successfully maintain livestock before purchase.
